Terms of Use
These terms cover your use of the CarCapt app and this website, both made and operated by deAgony Software LLC. By using CarCapt, you agree to them. They’re short, and in plain English.
The app and your license
CarCapt grants you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your own personal or business recordkeeping. Apps installed from the App Store are also covered by Apple’s standard Licensed Application End User License Agreement, which these terms supplement.
Beta software
CarCapt is currently pre-release (beta) software, provided on an “as is” and “as available” basis. Features may change, behave unexpectedly, or be removed, and availability isn’t guaranteed. Keep your own backups of anything important to you.
Not tax, legal, or financial advice
CarCapt helps you keep records and computes estimates: efficiency, cost per mile, spending, and IRS-style mileage logs. These are tools, not advice. You are responsible for the accuracy of what you log and for verifying any figures, especially tax deductions, with a qualified professional. CarCapt is not responsible for decisions you make based on its calculations.
Your data and privacy
Your CarCapt data stays on your device, and in your own iCloud only if you turn that on. How your information is handled is described in the Privacy Policy.
Third-party services
Some optional features connect to outside services: NHTSA for VIN decoding, OpenChargeMap for station details, Apple Maps for maps and geocoding, and Smartcar if you connect a car. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them.
Acceptable use
Please use CarCapt lawfully. Except where the law expressly permits it, don’t reverse-engineer, decompile, resell, or attempt to disrupt or gain unauthorized access to the app.
Intellectual property
The CarCapt name, app, design, and content are owned by the developer. Apple, iPhone, iPad, Apple Watch, Apple Vision Pro, Mac, and App Store are trademarks of Apple Inc. You keep ownership of the data you enter.
Disclaimer and limitation of liability
To the fullest extent permitted by law, CarCapt is provided without warranties of any kind, and the developer will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the app. Your sole remedy if you are dissatisfied is to stop using it.
Changes to these terms
We may update these terms from time to time. When we do, we’ll change the “last updated” date above, and your continued use of CarCapt means you accept the revised terms.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules.
